IMPORTANT DISCLAIMER: Our AI provides predictions based on visual analysis patterns. Actual social media engagement depends on many factors beyond our control including timing, audience, and platform algorithms. Predictions are estimates, not guarantees.

3. Account Registration

To access certain features, you may need to create an account. When registering, you agree to:

  • Provide accurate and complete information
  • Maintain the confidentiality of your account credentials
  • Accept responsibility for all activities under your account
  • Maintain only one account per person
  • Notify us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions and Payments

4.2 Pro Tier

  • Up to 10 photos per batch
  • Unlimited monthly analyses
  • Priority processing
  • Caption generation and hashtag suggestions
  • Side-by-side comparisons
  • Analysis history

4.3 Payment Terms

  • Subscriptions are billed through Apple App Store or Google Play Store
  • Subscriptions auto-renew unless cancelled
  • Cancel anytime in your device settings
  • No partial refunds for unused periods
  • Refund requests should be directed to Apple or Google

4.4 Price Changes

We reserve the right to change subscription prices. Price changes will be communicated in advance and will apply to your next billing cycle.

5. Acceptable Use

You agree NOT to use the Service to:

  • Upload illegal, harmful, or offensive content
  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Upload content you do not have rights to use
  • Attempt unauthorized access to our systems
  • Reverse engineer, decompile, or disassemble the app
  • Use automated scripts, bots, or scraping tools
  • Resell, redistribute, or sublicense the Service
  • Use the Service for any unlawful purpose

6. Intellectual Property

6.1 Your Content

You retain all rights to the photos and content you upload. By using the Service, you grant us a limited, non-exclusive license to process your content solely for the purpose of providing the Service. This license terminates when you delete your content or account.

6.2 Our Content

The Service, including its design, features, functionality, branding, and AI models, is owned by Driborn and protected by intellectual property laws. No rights are transferred to you except the limited license to use the Service.

7. Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you agree to our data collection and use practices as described in the Privacy Policy.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy of AI predictions

We do not warrant that:

  • The Service will be uninterrupted or error-free
  • Results will be accurate or reliable
  • The quality of any predictions will meet your expectations

AI predictions are estimates only. Social media engagement depends on many factors including timing, audience, platform algorithms, and content quality. We make no guarantees about the actual performance of your posts.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POSTPICK AI AND DRIBORN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL.

In no event shall our total liability exceed the amount you have paid us in the past twelve (12) months. Some jurisdictions do not allow these limitations, so they may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless PostPick AI, Driborn, and their affiliates from any claims, damages, or expenses arising from:

  • Your use of the Service
  • Your content
  • Your violation of these Terms

11. Termination

By You: You may terminate your account at any time by visiting our Account Deletion page or through the app settings.

By Us: We may terminate or suspend your access immediately, without prior notice, for violations of these Terms. We may also terminate with notice for any reason.

Upon termination, your data will be deleted in accordance with our Privacy Policy.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through the app. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes shall be resolved in the appropriate courts.
